Power Tech Industries Ltd. believes that all of our employees have the right to work in an environment, which is free from all forms of violence and harassment. “Workplace Violence “, is defined as any behavior that physically or psychologically harms another person in the workplace. “Harassment”, is defined as any objectionable conduct, comment or display by a person that:
A.is directed at an employee;
B.is made on the basis of race, creed, religion, color, sex, sexual orientation, marital status, family status, disability, physical size or weight, age, nationality, ancestry or place of origin; and
C.constitutes as a threat to the health or safety of the employee.
“Employee” is defined as any person (management or worker) who works for a wage or salary for our company.
We will make every effort to ensure that no employee is subjected to violence or harassment at any of our places of employment by performing a workplace violence assessment in conjunction with the OHS Committee. Our management is committed to keep this policy, and see that no employee causes or participates in the acts of violence or harassment towards another employee.
All employees will be trained in this policy at initial orientation, safety meetings, and through postings on the OHS bulletin boards.
PROCEDURE FOR DEALING WITH VIOLENCE OR HARASSMENT
1.Employees are encouraged to address alleged incidents of workplace violence or harassment internally.
2.An employee who believes that he/she has been subjected to violence or harassment is encouraged to clearly and firmly make known to the alleged harasser that the violence or harassment is objectionable and must stop.
3.Where circumstances prevent an employee from taking action, or the action taken has been unsuccessful, the employee should report the alleged violent act or harassment to Senior Management, as these persons are designated by our company to receive these complaints.
4.The company will notify the alleged perpetrator of the complaint, provide him / her with information concerning the circumstances of the complaint and undertake a confidential investigation.
5.Following the conclusion of the investigation, the company will inform the employee and the alleged perpetrator of the results of the investigation.
RESOLUTION, CORRECTIVE ACTION AND CONFIDENTIALITY
1.Where the violent act or harassment has been substantiated, the company will take appropriate corrective action to resolve the complaint.
2.Where the violent act or harassment has not been substantiated, no action will be taken against an employee who has made a complaint in good faith. However, a deliberate false accusation of violence or harassment will be met with strong discipline.
3.Power Tech Industries Ltd. will not disclose the identity of the employee or the circumstances of the complaint, except where disclosure is necessary for the purpose of investigating or taking disciplinary action in relation to the complaint, or where the law requires such disclosure.
4.Nothing contained in this Workplace Violence and Harassment Policy shall discourage or prevent an employee from referring a violence or harassment complaint to the Occupational Health & Safety Division, pursuant to the Occupational Health & Safety Act, initiating a complaint under the Provincial Human Rights Code, or exercising any other legal rights available under any other law.
5.The Workplace Violence and Harassment Policy is subject to review if any of the following occur:
a.A harassment or violence incident has occurred.
b.A review is requested by the OHS committee.
c.The policy will be reviewed every 3 years.
