A supervisor or manager of an employee must request that an employee submit to alcohol and drug testing if the supervisor or manager, and the next level of management, have reasonable grounds, as defined under definitions, to believe that an employee was involved in an incident or near miss due to the use of alcohol or drugs. The employee must be provided the reason for the request.
A drug and alcohol test may not be requested if there is objective evidence to conclude the use of alcohol or drugs did not contribute to the cause of the incident or near miss.
