Alcohol and drug testing results can be negative, positive, tampered, invalid, or inconclusive. A negative test result implies the employee is in compliance, a positive test result implies non-compliance, a tampered test result implies non-compliance, and an invalid or inconclusive test result cannot be relied upon to determine compliance or non-compliance.
The designated company representative and any person to whom disclosure is permitted under this policy must not disclose the test results to any person other than a person who needs to know the test result to discharge an obligation under the policy.
The employee will be notified of all test results. If test results are negative, no further actions under the alcohol and drug policy or the progressive discipline policy shall be taken. If test results are positive or show the sample has been tampered with, the employee may face disciplinary actions as per the alcohol and drug testing policy and the progressive discipline policy. Such discipline may include termination for cause, depending on the facts of each case, including the nature of the violation, the existence of prior violations, the response to prior corrective programs, and the seriousness of the violation.
If it is determined the alcohol and/or drug dependencies are classified as a disability as per current legislations, the employee will be directed to meet with an SAE, EAP, or EFAP. This is to determine the level of assistance required by the employee. A confidential written report will be provided to the employer and the employee listing their recommendations. Failure of an employee to attend an assessment or follow the recommended treatment program may be cause for termination.
